These Terms and Conditions set out the basis on which Waste Disposal Brompton provides waste collection and related services to residential and commercial customers. By making a booking, confirming a quotation, or allowing our operatives to collect waste from your premises, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, business, company or organisation that requests or receives services from Waste Disposal Brompton.
Services means waste removal, waste collection, bulky item collection, recycling, and any related services provided by Waste Disposal Brompton.
Waste means any materials, items, goods or refuse presented by the Customer for collection and disposal, including general household waste, commercial waste and recyclable materials, but excluding any prohibited items as specified in these Terms and Conditions.
Contract means the agreement between Waste Disposal Brompton and the Customer for the provision of Services, consisting of these Terms and Conditions and any written quotation or booking confirmation.
Waste Disposal Brompton provides waste removal and waste collection services to domestic and commercial properties within its designated service areas. The specific service area and availability may vary from time to time and will be confirmed at the time of booking.
Services may include single collections, ad hoc clearances, and scheduled collections for ongoing waste management. Details of the Services, including the type and estimated volume of waste to be collected, will be set out in the quotation or booking confirmation.
Waste Disposal Brompton reserves the right to refuse to collect any waste that is hazardous, prohibited by law, not correctly identified by the Customer at the time of booking, or which, in the reasonable opinion of our operatives, may pose a risk to health, safety, vehicles or property.
Customers may request a quotation or book Services by telephone, email, or through any booking system operated by Waste Disposal Brompton. At the time of enquiry, the Customer will be asked to provide accurate information about the type, quantity and location of the waste, as well as access details and any relevant site information.
Any quotation provided will be based on the information supplied by the Customer and is subject to inspection of the waste on arrival. Quotations are not binding until confirmed by Waste Disposal Brompton, and may be revised if the actual waste or access conditions differ materially from the description provided.
A booking will be deemed accepted once Waste Disposal Brompton issues a confirmation by email, message or verbally, and the Customer accepts the quoted price and proposed date and time window for collection.
Customers are responsible for ensuring that all details in the booking confirmation are correct. Any amendments requested by the Customer are subject to availability and may result in changes to the quoted price or collection time.
The Customer must ensure that our operatives have safe, unobstructed access to the collection point at the agreed time. This includes arranging necessary permissions for access through shared areas, securing parking or loading space where required, and ensuring that any gates, doors or security systems can be operated or opened for the purpose of the collection.
The Customer must present the waste in a manner that is safe and suitable for handling and loading, for example in bags, containers, or stacked in a way that does not create a risk of injury or damage. The Customer must inform us in advance of any heavy or awkward items requiring special handling.
If our operatives are unable to access the waste, or if access is delayed or hazardous due to circumstances within the Customer's control, Waste Disposal Brompton may, at its discretion, apply an abortive or waiting charge, or treat the booking as cancelled by the Customer in accordance with the cancellation terms below.
The Customer must accurately describe the waste to be collected at the time of booking. Waste Disposal Brompton is not obliged to collect any items that were not disclosed or which fall into prohibited categories.
Prohibited waste may include, but is not limited to, asbestos, pressurised containers, certain chemicals, clinical or medical waste, radioactive materials, flammable substances, explosive materials, gas bottles, oil, paint in liquid form, and any other items that are restricted under applicable waste legislation or cannot be safely handled by our operatives.
Where possible and lawful, we may agree to collect certain special or hazardous wastes by prior arrangement and subject to additional charges, documentation and handling procedures. Any such arrangements must be confirmed in writing before collection.
If prohibited waste is discovered during collection, our operatives may refuse to remove it, or may remove only the non-prohibited portion of the load. Any additional costs incurred, including safe containment or making the site safe, may be charged to the Customer.
Prices for Services are generally based on factors such as the volume, weight and type of waste, the time required to load, and access conditions. Any quotation given prior to collection is an estimate based on the information provided and is subject to revision following inspection of the waste.
If, on arrival, the actual quantity or type of waste is greater than described, or access is more difficult or time-consuming than reasonably anticipated, Waste Disposal Brompton may revise the price and seek the Customer's consent before proceeding. If the Customer does not agree to the revised price, the booking may be treated as cancelled and an attendance or abortive charge may apply.
All prices are stated in pounds sterling and may be subject to applicable taxes. Any taxes or governmental charges arising in connection with the Services will be added to the price where required by law.
Unless expressly agreed otherwise, payment is due in full before or at the time of collection. Waste Disposal Brompton may accept payment by cash, card or other methods as advised at the time of booking.
For business customers or account holders, payment terms will be agreed separately. Invoices are payable within the period specified on the invoice. If no period is stated, payment must be made within 14 days of the invoice date.
Waste Disposal Brompton reserves the right to charge interest and reasonable recovery costs on overdue amounts in accordance with applicable UK legislation relating to late payment. We may also suspend or cancel further Services until outstanding balances are cleared.
The Customer may cancel or amend a booking by contacting Waste Disposal Brompton during normal business hours. Cancellations or changes are only effective when confirmed by us.
If the Customer cancels with sufficient notice, any prepayment may be refunded or credited, subject to any applicable administration charge. If the Customer cancels at short notice, fails to provide access, or is not present where required at the time of collection, Waste Disposal Brompton reserves the right to charge a cancellation or attendance fee to cover wasted time and transport costs.
The level of any cancellation or attendance fee will depend on the timing of the cancellation and the nature of the booking, and will be communicated to the Customer at the time of booking or upon cancellation.
Waste Disposal Brompton may cancel or reschedule a booking where necessary due to operational reasons, safety concerns, extreme weather, vehicle breakdown, staff illness, or other circumstances beyond our reasonable control. Where this occurs, we will use reasonable endeavours to notify the Customer and arrange a suitable alternative time. Our liability in such circumstances is limited as set out in the limitation of liability section.
Our operatives will use reasonable care and skill when carrying out waste collection and loading. The Customer acknowledges that clearance work can be physically demanding and may involve the movement of bulky or awkward items through confined spaces, staircases, entrances or external areas.
The Customer is responsible for protecting any items, fixtures, surfaces or areas that may be susceptible to damage during the normal course of loading and removal. This includes, for example, protecting floors, walls, door frames and fixtures where particularly delicate finishes are present.
Waste Disposal Brompton will not be responsible for normal wear and tear or minor cosmetic damage that may reasonably occur as part of moving waste out of a property, provided our operatives act with reasonable care.
Title to the waste transfers to Waste Disposal Brompton at the point of loading onto our vehicles, subject to the waste being lawful and permitted. Risk in the waste also transfers to us at that time.
Waste Disposal Brompton will transport and dispose of or recycle the waste at authorised facilities in accordance with applicable waste management legislation and duty of care requirements. We will take reasonable steps to maximise recycling and recovery where practicable, but do not guarantee that all items will be recycled.
The Customer confirms that they have the right to dispose of the waste and that no items collected are subject to retention of title, security interests, disputes of ownership, or any legal restriction preventing their removal.
Waste Disposal Brompton operates in accordance with relevant UK waste regulations, including duty of care requirements relating to the handling, transport and disposal of controlled waste. Where required, appropriate documentation will be produced or retained as evidence of lawful disposal.
The Customer undertakes to provide accurate information about the nature of the waste to enable us to comply with our legal obligations. Where the Customer provides false or incomplete information that leads to a breach of waste regulations, the Customer may be held responsible for any resulting liabilities, penalties or costs incurred by Waste Disposal Brompton.
The Customer agrees not to request or encourage any action that would involve unlawful dumping, fly-tipping, burning of waste or any other practice contrary to environmental or waste legislation.
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited or excluded under UK law.
Subject to the above, Waste Disposal Brompton will not be liable for any indirect, consequential, special or economic loss, including loss of profit, revenue, business, data or goodwill, arising out of or in connection with the Services or these Terms and Conditions, whether in contract, tort or otherwise.
Waste Disposal Brompton's total aggregate liability to the Customer in respect of any claim or series of connected claims arising from the Services shall not exceed the total amount paid or payable by the Customer for the specific Service giving rise to the claim.
The Customer must notify Waste Disposal Brompton in writing of any alleged loss or damage as soon as reasonably practicable and in any event within 7 days of the date of collection. Failure to notify within this period may affect our ability to investigate and may reduce or extinguish any liability we may have.
The Customer agrees to indemnify Waste Disposal Brompton against all claims, liabilities, costs, damages and expenses arising from any breach by the Customer of these Terms and Conditions, including but not limited to any misdescription of waste, failure to disclose hazardous items, or breach of waste regulations.
Waste Disposal Brompton will not be in breach of these Terms and Conditions or liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control, including but not limited to severe weather, accidents, road closures, acts of authorities, strikes, lockouts, equipment failure, or interruptions to power or communication systems.
Waste Disposal Brompton may collect and process personal data relating to the Customer in order to manage bookings, provide Services, process payments, and comply with legal and regulatory obligations. Personal data will be handled in accordance with applicable data protection legislation in the United Kingdom.
By using our Services, the Customer consents to the use of their personal information for these purposes. Customers may contact us to request access to, correction of, or deletion of their personal data, subject to legal requirements and our legitimate business needs.
Waste Disposal Brompton may update or amend these Terms and Conditions from time to time. The version of the Terms and Conditions that applies to a particular booking will be the version in force at the time the booking is confirmed.
Any changes that materially affect the rights and obligations of existing contracts will be communicated where reasonably practicable.
If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.
These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between Waste Disposal Brompton and the Customer in relation to the Services. The Customer acknowledges that they have not relied on any statement, promise or representation that is not set out in the Contract.
These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Disposal Brompton.
